Mercier Body Corporate Developments offers to developers and bodies corporate, which have not been previously established or operational, a full range of body corporate establishment services. We deal with many developers.
Services include advice on the requirements for a community management statement and appropriate by-laws, convening of all necessary body corporate meetings, establishment of the body corporate books and records and other administrative procedures, and all other procedures a new body corporate might require.
Assistance with planning, and the preparation of particular documentation including:
Attendances to obtain instructions for, and to provide advice for inclusions in CMS, and thereafter, preparation of the CMS to accompany the survey plan;
- Attendances to obtain instructions for, and preparation of, disclosure statement for inclusion in contracts of sale of lots;
- Establishment of all necessary rolls, registers and records of the body corporate;
- Preparing a first budget for the administrative and sinking funds for the first year;
- Obtaining relevant quotes for insurance;
- Expert advice on exclusive use and other by-laws for inclusion in the CMS (if required - for example, inclusions in by-laws of matters arising in special conditions in contracts of sale, e.g. allowing the keeping of pets by certain owners);
- Preparation of necessary exclusive use by-law for inclusion in CMS;
- Attendances to obtain local authorisation notation on the CMS, and thereafter ensure registration of the plan and CMS to establish the body corporate;
- Expert advice on any common property, or body corporate related issues (for example, occupation authorities by a service contractor);
- Provision of relevant section 205, and 206 or 213 certificates on behalf of the body corporate;
- Offering expert advice on the requirements for appointment of service contractors (e.g. the resident manager / letting agent (if any));
- Establishment of books, records and registers of the body corporate;
- All other attendances associated with the above matters to ensure establishment of the body corporate, its compliance with legal requirements upon establishment and to allow the sale of lots to contracted purchasers;
- Preparing notices, convening and attend inaugural AGM of the body corporate;
- Attending to all matters necessary to legally establish the body corporate.

Qualifications
Marc holds a Bachelor of Science (majoring in Anatomy, Physiology and Forensics), a Bachelor of Laws and a Master of Laws (specialising in litigation and dispute management) from the University of Queensland, is admitted as a Barrister-at-Law of the Supreme Court of Queensland and of the High Court of Australia, with a current practicing certificate, and is a Nationally Accredited Mediator in Australia through Bond University and the University of Queensland.
Marc is also a Family Dispute Resolution Provider, pursuant to the Family Law Act 1975 (Cth) and through the Practitioner Registration Unit of the Federal Attorney-General's Department.
Background & Experience
Initially, Marc commenced practice solely as a Barrister-at-Law, engaging as counsel on behalf of the Queensland Office of the Director of Public Prosecutions, prosecuting a broad range of criminal matters, including confiscation of proceeds of crime, complex Supreme Court bail applications, sentencing and prosecution of serious offences, appearing before every Supreme and District Court Judge at that time.
Marc then commenced work at the Private Bar of Queensland as a Barrister-at-Law, undertaking a broad range of matters concerning commercial, property, industrial, family and criminal law. Additionally, Marc conducted mediations, civil and criminal trials, and applications in the jurisdictions of the Court of Appeal, Supreme Court, Industrial Court, Family Court and lower courts.
Marc's broad experience and high-level qualifications allow him to assist bodies corporate in complex matters, which often touch on subsidiary body corporate issues.
In furtherance to a specialisation in Alternative Dispute Resolution, Marc commenced a PhD at the University of Queensland, concurrently engaging in conciliation work at the Residential Tenancies Authority as a Senior Conciliator, and then as a Conciliator at the Office of the Commissioner for Body Corporate and Community Management. Marc was also manager of the BCCM conciliation service for a period during 2007.
Marc was further appointed as Principal Conciliator with the Anti-Discrimination Commission in Queensland, where he had carriage of highly complex and media-sensitive matters, often involving body corporate schemes as a party.
Marc’s appointment within the Office of the Commissioner for Body Corporate and Community Management has included the undertaking of complex conciliations concerning the jurisdiction of the Body Corporate and Community Management Act 1997 (Qld), associated regulation modules and other closely-related legislation. In his time as Conciliator, Marc was also involved in the development of policy within the Department, including the creation of the Department Conciliator’s Code of Conduct and other processes involving the interpretation of legal provisions defining the role of Conciliator and conciliation practice.
During his position as Senior Conciliator in the Residential Tenancies Authority and Conciliator at the Office of the Commissioner for Body Corporate and Community Management, Marc gained expert knowledge of the respective legislation administered by those bodies and remains an expert in the field of Alternative Dispute Resolution.
